GENERAL CONDITIONS
PRODUCER AND ORGANISER: TTE S.r.l.
VALIDITY OF THE PROGRAMME: from 01.01.2005 to 31.12.2005
CONDITIONS
Are specified in the document that all participants of the trip will recieve, with the possibility of subscribing an insurance covering the cancelation fees of the total cost of the trip.
INSCRIPTION FEES
The fees and additional charges are indicated in the price list of the present catalog and have been set up following the costs and quotations valid at 31/10/2003.
If, at the moment of initialising the stay, strong differences concerning exchange, transports, taxes on certain services, like airport taxes, harbour taxes, are noted, the inscription fees could be modified accordingly. The variations of prices and costs could be communicated to the participants at the beginning of the stay without the possibility for the participant to cancel the contract if the price change is not superior to 10%. In the case the increase is superior the possible cancelation has to reach us within 48 hours of the
communication.
RESERVATIONS AND PAYMENT
The reservations have to be done on the given form and have to be accompanied by a down payment of 30% and the inscription fee and are accepted in all authorised travel agencie. The reservations are considered final only after the confirmation of our organisation. For reservations 30 days before the beginning of the departure, the whole amount due has to be payed at the moment of the reservation.
The reservation of the stay automaticallty implicates the full acceptation of all the conditions mentioned in the present general
conditions.
QUALITY AND QUANTITY OF THE SERVICES
The location of the apartments and/or hotels are indicated inside the present catalog. Concerning the categories of the apartments, they are all classified as CAV/3 (Houses, apartments for vacations). All the apartments hold an authorisation 'CAV' of the Capoliveri (Livorno) municipality dated 18/09/90 countersigned with the number 106 and renewed every year. The descriptions included in the present catalog are exact and done in good faith. The company declines all responsibilities for mistaken information coming from a third party not being part of the company. In case of a complaint, the customers should immediately contact the Direction of the company and confirm, within 24 hours, in written form the
claims.
RENUNCIATION BY THE CUSTOMER
The participant who has to cancel his trip, for whatever reason, has the right of a refund, excepted the inscription fees and the cancellation penalties, hereunder shown, in addition to the cost and fees for the cancellation of the services.
For stays in apartments or hotels, individual travels or national and international group travels, with the use of regular or special services in this sector (charters, flights, boat rentals etc.)
* 10% of the reservation down payment until 30 working days before the departure (Saturday excluded)
* 25% between 29 and 21 working days before the departure (Saturday
excluded)
* 50% between 20 and 11 working days before the departure (Saturday excluded)
* 75% between 10 and 3 working days before the departure (Saturday excluded)
* No refund after this.
CANCELLATION OF THE TRIP OR STAY BY THE ORGANISER
The organisation can cancel the contract at any moment following article n°10 of the law n°1084 dated 27 December 1977, ratification and execution by the International Convention concerning travel contracts (CCV), without any other obligation then to refund the already payed sums :
a) for exceptional circumstances.
b) when the minimum number of participants for a trip is not reached and if this fact is communicated to the participant at least 15 days before the departure.
In addition, concerning stays in apartments, if for circumstances beyond control and independant of the organisers will, a previously rented accomodation could not be put at the disposition of the customer, the organisers reserve the right to change to another accomodation with similar caracteristics, and if the customer refuses the change, to cancel the reservation with the only obligation to refund the already payed
sums.
INSURANCE GUARANTEE
The risks versus persons participating at travel and vacation programs shown in the present catalog as well as the guarantee of the exact fulfilment of the opbligations versus the user of the touristic services and in observation of the regulations foreseen by the 'Convenzione Internationale' concerning travel contracts (CCV), law of 27.12.1977 n°1084 and the European Community Directive n°90/314 dated 13.06.1990, concerning travel programs "All Included" are guaranteed by the public liability insurance policy with the company SAI- Società Assicuratrice Industriale S.p.A. - Agency of Portoferraio with the insurance number n° 704326332/08.
The above mentioned insurance policy covers the following risks with the following maximum refunds:
1) Material or corporal damages:
* maximum for every damage Euro 1.549.370;
* with the limit, for each person, received corporal damages Euro 516.456;
* with the limit for material damages:
a) for every damage Euro 258.000
b) for every person Euro 15.493
2) Property loss :
* maximum for every insured year Euro 25.822
* with the limit, for every damage Euro 12.911
ACTIVITY AUTHORIZATION
The organising company is in possession of a legal public authorization by the Province of Livorno dated 26.05.99.
TRAVEL CONTRACTS AND RESPONSIBILITY
All contracts mentioned in relation with the present catalog are submitted to the regulation of the Convention of the L.R. Toscana n°16/94, article 3 (CCV) and this despite any contradictory clause. All above contracts are also submitted to the European Community regulation n°90/314, and this despite any contradictory
clause.
CONFORMITY DECLARATION
The present travel and vacation programs are in conformity with the text verified by the Province of Livorno following the law of Tuscan Region
n.16/1994.
RESPONSIBILITY OF CARRIERS (AIR/SEA)
The present catalog is emitted behind the responsibility of the touristic operator. It is not emitted on behalf of air/sea carriers here mentioned or air/sea carriers used during the different travels.
ANIMALS
Animals are only accepted after confirmation from our company.
NOTA BENE
Please be aware that neither our organisation nor the owners of the apartments are insured and covered against theft and housebreaking and can therefore not be held responsible for any value items left in the
apartments.
PLACE OF JURISDICTION
Competent in case of litigation will be the jurisdiction where our organisation has its registered offices.
